Conditions of use for the E-Commerce Service


Legal Services To Make Web Based Activities Compliant With The Legal Framework On Information Society’S Services

  1. The Information Society service (hereinafter “Service”) is an on-line service and therefore subject – amongst the others – to the provisions of the applicable sectorial normative (in particular, to Legislative Decree 9 April 2003, n. 70 “transposition of the Directive 2000/31/EC on certain legal aspects of information society services, in particular electronic commerce, in the internal market” and to Legislative Decree 6 September 2005 "Consumers' Code"), and also to the Deontological Forensic Code provisions.

  2. According to the art. 17, II, paragraph B) and to the aforementioned Legislative Decrees we herewith provide you with the following information:

    2. Tonucci & Partners Attorneys are pledged to abide scrupulously by the current version of the Deontological Forensic Code (click for the entire document) in providing all the Services available on the Portal and in performing any activity in connection with the Portal.
    3. The responsible for all Services is Mario Tonucci.
    4. The relative insurance policy has been signed by Tonucci & Partners with the insurance company Reale Mutua Assicurazioni – policy number 037403 valid from 15-02-2001 with a maximum coverage of Euro 7,6millions(Euro sevenmillionssixhundredthousands)/00).
    5. The professional fees amount for Services is calculated in conformity with the professional fees published on the New Forensic Fee Book approved with Ministerial Decree 08/04/2004. n. 127, Gazzetta Ufficiale, Supplemento Ordinario, n.115 of 18/05/2004.To display the integral text click on Nuovo Tariffario Forense.

  3. Further information on the Service are available on the Introduction page and by accessing other pages of the guided procedure to request estimates on E-commerce services, as provided by the normative in force (Legislative Decree 70/2003 and Legislative Decree 2006/2005), and in particular: instructions on drawing up contracts (requesting estimates, eventual acceptance, concluding the contract); how to store on-line contracts and relative access modalities; instruments available to users to find out and correct data errors before sending inquiries (it’s always possible to correct errors while formulating and forwarding the request).

  4. With regard to Service withdrawal right as set out in the art. 64 of the Legislative Decree 206/2005, we inform You that such right does not apply to subjects requesting the Service for aims referable to their professional activity). In case consumers request the Service (that is to say, physical persons requesting the Service for aims not referable to their professional activity), withdrawal right is excluded in comply with art. 55 of the Legislative Decree 206/2005.

  5. Personal data processing in connection with the Service will fully comply with the provisions of Legislative Decree 30 June 2003, n. 196 and the annexed Unified Text of norms on data protection or “Data Protection Code”, as set out in the ad hoc Informative based on the art. 13 of the Code on modalities and aims for personal data processing.

  6. Users agree to use the Service only for legitimate purposes, and to be the sole and full responsible for any misuse or illegitimate use of information, data etc. related to the Service. In particular, Users agree to buy privacy models and/or statements exclusively to perform duties regarding data processing policies within their own organization. It is prohibited to Users any other use, including any form of use for profit, of the Models purchased through the Service. Tonucci & Partners, disclaims any responsibility toward third parties with regard to purchased model’s use in breach of the present Particular Conditions, and reserves the right to take all appropriate protective actions at all levels (including actions for damages compensation) against the violation of the present Particular Conditions.

    For what concerns modalities for requesting and using the Service, we inform You of the following:

For what concerns modalities for requesting and using the Service, we inform You of the following: Request E-Commerce models Users will access a list of Information Society related models and statements. Introductive instructions for each model will be displayed and Users can select the one or ones they intend to purchase.
    2. Subsequently, Users will fill out an electronic form. Sending the form, with the list of selected Information Society related models, will not imply any economic or whatsoever obligation for Users.
    3. Tonucci & Partners reserves the right to accept the request, and only in such case, the Information & Communication Technology Department Attorneys will send you an E-mail message with the fee amount estimate for the purchase of models, and the modalities of payment (bank transfer).
    4. In case of User’s acceptance of the estimate and upon receipt of the full amount due, Tonucci & Partners will send by e-mail the selected and purchased E-commerce models with attached invoice for the relative amount (that will be sent also to the geographical address indicated by Users in the request form).
