Informative according to art. 13 of Data Protection Code (Legislative Decree 30 June 2003, n. 196 including the Unified Text of norms for person’s and other subjects protection issues regarding personal data processing) Dear Mr./Miss, we would like to inform you that, according to the article 13 of the Legislative Decree 30 June 2003, n. 196 including the Unified Text of norms for person’s and other subjects protection issues regarding personal data processing (hereinafter “Code”), the information and data you provide: 1) while filling the electronic form for applying to a job position at Tonucci & Partners; 2) while sending on-line a curriculum vitae et studiorum following the instructions provided for in the present section of the Portal will be object of data processing in comply with the above mentioned provisions and the confidentiality obligations which inspire the activity of Tonucci & Partners. For personal data processing we intend any operation or set of operations, carried out even without electronic devices, concerning the collection, recording, organization, storage, consultation, elaboration, modification, selection, extraxtion, comparison, use, interconnection, block, communication, diffusion, erasure and destruction of data even when not inserted in a databank. According to the article 13 of the Code, we provide you the following information. The data processing we intend to operate: a) It has the following aims: receiving applications for job positions inside Tonucci & Partners sent by users, evaluate the professional profiles of interest emerging from received curriculum vitae, manage all the phases of personnel selection (communications with applicants, job interview, etc.) b) It will be carried out with the following modalities: by using electronic devices. In particular, the CV received and/or the information sent by filling out the electronic form available on-line will be stored in a proper Data Bank administrated by the Data Controller Tonucci & Partners. The eventual printing out of CV will involve also a manual processing of the contained information. c) The data will be communicated only to Lawyers and other professionals of Tonucci & Partners (i.e. recruiting responsible), with the purpose of carrying out the selection procedures within Tonucci & Partners. Your data will not be diffused. d) According to the article 13, paragraph 1, letter d) we therein inform you, about the subjects and categories to whom your personal data could be communicated or that could come to know it as subjects in charge of the processing: Attorneys, secretarial staff, Administrative staff, informatics technicians administrating Tonucci & Partners intranet. We inform you that providing such data is optional, but the eventual refuse to confer it would prevent us from proceeding with the evaluation of the professional profiles and with the consequent personnel selection. The Data Controller essential data are: Associazione Professionale Tonucci & Partners, Via Principessa Clotilde n.7 CAP 000196 Roma, tel.+39 06 362271 – Fax +39 06 3235161 – e-mail: mail@tonucci.it. The data will be stored at the Data Controller seat, for the timeline prescribed by the related normative. However, we will store your personal data in relation with the expansion’s necessities of Tonucci & Partners organization that could imply the selection procedure’s execution at a later stage. Periodically, we will erase from the Data Bank the CV of no actual interest, even under your indication with a simple message to: mail@tonucci.it. We would like also to inform you that such data will be collected, processed and stored fully complying with the provisions set out in the articles 31 and subsequent of the Data Protection Code and in the Code’s Technical Disciplinary Annex B – for minimum safeguard measures issues. Regarding the sensitive data processing, that is to say all the information that could unveil your racial or ethnic origin, religious, philosophical or other kind of beliefs, political opinions, membership in political parties or labor unions, membership in religious, philosophical, political or labor associations or organizations, as well as data that could unveil your health status or sexual preferences, we inform you that, when unnecessary, it’s better to avoid inputting such personal data in your CV. However, when the disclosure of such information is necessary (i.e. a candidate of protected working categories) apart from your agreement to common personal data processing, before sending your data, it’s also necessary a specific agreement – by marking the right box of the agreement displayed after the informative – to process the sensitive data contained in the CV or in the electronic form; in absence of such agreement, according to the normative provisions for personal data protection, the Data Controller – Tonucci & Partners – will erase all the relative information. The same aims and modalities for data processing above illustrated will be applied also to your sensitive information, when indicated, fully conforming to all norms of Data Protection Code applicable to particularly delicate data processing. Likewise, the personal data will be processed fully abiding to the self-regulation norms for personal data processing contained in the sector’s Deontological Codes in force and eventually applicable (i.e. Deontological Code on personal data processing in labor issues). With reference to the use on the Portal of technologies and/or techniques to access information recorded in user’s or member’s terminal or to monitor user’s operations, we inform you that such use will be performed only for legitimate purposes, relative to the technical memorization of data limited to the time necessary to transmit the communication or to answer your requests. We also remind you that, should such web navigation tracing/marking systems be operative the user has always the possibility to deactivate those applications by modifying the browser’s settings, and anyway can refuse such processing with a communication to the Data Controller. You can contact the Data Controller at any time, without formal obligations (via e-mail, telephone or fax) or by using the proper form preset by the Autorità Garante for personal data protection (available on the web site www.garanteprivacy.it) to weigh your rights as set in the article 7 of the Code, hereby integrally reproduced for your convenience. We remind you that the procedures for sending your curriculum vitae through the dedicated section of our web Portal always allows the applicant to autonomously manage the information previously sent. For example, you will always have the possibility to access such information (through previous assignation of a user id and a password) in order to integrate, update, or erase it in full autonomy. Art. 7 (Access right to personal data and other rights) 1. The interested subject has the right to obtain the confirmation of the existence or not of personal data regarding him, even if not yet recorded, and has the right to obtain the communication of those data in an intelligible form. 2. The concerned subject has the right to obtain the indication of: a) the origin of personal data; b) purpose and modalities of their processing; c) the logic applied in case of data processing performed through electronic devices; d) the essential data of the Data Controller, of the responsible and of the representative appointed in conformity with the article 5, paragraph 2; e) the subjects or the categories of subjects to whom the personal data could be communicated or that can come to know it as representative appointed in State’s territory, as responsible or person in charge. 3. The concerned subject has the right to obtain: a) the updating, the rectification or, when interested in, the integration of his own data; b) the erasure, the transformation into an anonymous form or the block of data processed in violation of the law, including data whose storage is not necessary in relation to the purposes for their collection; c) the statement that the operation under letter a) and b) are well known, also for what concerns their content, to all the person who received communication of personal data, except in the case where such obligation involves a manifestly disproportioned financial burden in comparison with the protected right. 4. The concerned subject has the right to oppose, in whole or partially: a) for legitimate reasons, to the processing of his personal data although relevant with their collection’s purpose; b) to the processing of his personal data with the intent of sending advertising material or direct sale material or to carry out market researches or commercial communications.
