The On-line Consulting service
(hereinafter “Service”)
is an on-line service and therefore subject – amongst
the others – to the provisions of the applicable
sectorial normative (in particular, to Legislative
Decree 9 April 2003, n. 70 “transposition of
the Directive 2000/31/EC on certain legal aspects
of information society services, in particular electronic
commerce, in the internal market” and to Legislative
Decree 22 May 1999, n. 185 “Transposition of
Directive 97/7/EC the protection of consumers in
respect of distance contracts”), and also
to the Deontological Forensic Code provisions.

According to the art. 17, II, paragraph B) and to
the aforementioned Legislative Decrees we herewith
provide you with the following information:

Tonucci & Partners
Attorneys are pledged to abide scrupulously
by the current version of the Deontological
Forensic Code (click
for the entire document) in
providing all the Services available on the
Portal and in performing any activity in
connection with
the Portal.

The responsible for all Services is Mario
Tonucci.

The relative insurance policy has been
signed by Tonucci & Partners with the
insurance
company Reale Mutua Assicurazioni – policy number
037403 valid from 15-02-2001 with a maximum coverage
of
Euro
7,6millions(Euro sevenmillionssixhundredthousands)/00).

The professional fees amount
for Services is calculated in conformity with
the
professional fees published
on the New Forensic Fee Book approved
with Ministerial Decree 08/04/2004.

Further information on the Service
is available on the Introduction page and by accessing
other pages of the guided procedure to request
estimates for On-line Consulting service, as provided
by the normative in force (Legislative Decree 70/2003
and Legislative Decree 185/1999), and in particular:
instructions on drawing up the contract (requesting
estimates, eventual acceptance, concluding the
contract); how to store the on-line contract and
relative access modalities (all user’s requests
and feedbacks, opinions, and memorandums will be
stored and accessible through the user’s
personal Control Panel); instruments available
to users to find out and correct data errors before
sending inquiries (it’s always possible to
correct errors while formulating and forwarding
the request).

With regard to Service withdrawal
right as set out in the art. 5 of the Legislative
Decree 185/1999, we inform You that such right
does not apply to subjects requesting the Service
for aims referable to their professional activity).
In case the Service is requested by consumers (that
is to say, individuals requesting the Service for
aims not referable to their professional activity),
withdrawal right is excluded in comply with art.
5, paragraph 3, lett. (a) Legislative Decree 185/1999.

Personal data processing in connection
with the Service will fully comply with the provisions
of Legislative Decree 30 June 2003, n. 196 and
the annexed Unified Text of norms on data protection
or “Data Protection Code”, as set out
in the ad hoc Informative based on the art. 13
of the Code on modalities and aims for personal
data processing. Users should observe the following
cautions when supplying personal data:
- Avoid supplying sensitive data (that is to
say all the information that could disclose user’s
racial or ethnic origin, religious, philosophical
or other kind of beliefs, political opinions,
membership in political parties or labor unions,
membership in religious, philosophical, political
or labor associations or organizations, as well
as data that could disclose user’s health
status or sex life) not relevant for the feedback.

Avoid supplying ordinary, sensitive
or judicial data that identifies or could identify
third subjects; should be necessary to supply
third subjects data, users anyway guarantee
to have obtained a prior consent from concerned
subjects on supplying and processing such data,
relieving Tonucci & Partners of any responsibility
and under any circumstance.

Users are requested to supply
only pertinent and necessary data when
formulating inquiries.
Service
Responsible will delete
all personal data deemed as not pertinent and
unnecessary.

For what concerns modalities for
requesting and using the Service, we inform You
of the following:

In the Request
for On-line Consulting page,
Users will access an electronic
form to be filled out and sent specifying area
of practice, inquiry and type of advice requested
(complete opinion or short memorandum). Instructions
on each model will be displayed and Users can
select the one or ones they intend to purchase.

By sending the form,
Users are only requesting for an estimate for
the relative advice service. Sending the form,
will not imply any economic or whatsoever obligation
for Users.

Tonucci & Partners reserves
the right to accept the request, and only in
such case, a competent Department Attorney
will send you an E-mail message with the fee
amount estimate for the type of advice requested,
indicating the time requirements for processing
the request (no longer than 7 working days
from the date of payment).

In case of estimate acceptance
users should use the On-line
Consulting Control Panel
accessible in
the Users Reserved Area
of Tonucci & Partners Portal to
proceed with the
payment.
- Payments can be done by Credit Card or Bank
Transfer following the guided procedures specified
in the User’s control panel.
- Only upon receipt of the full amount due,
the Competent Attorney will formulate and send
the complete opinion or short memorandum. The
legal advice will be transmitted by E-mail, posted
on-line in the User’s personal Consulting
Control Panel accessible with previously assigned
access keys, and sent by recorded delivery letter
with advice of delivery to the geographical address
specified in the registration form. In the latter
case you’ll find enclosed the invoice for
the paid amount.
