The implementation of the Model does not prevent Entities from their possible involvement in criminal trials, however:

• If implemented before the offence’s perpetration it may exclude the entity’s liability if the Court considers the Model “suitable” and “congruous”.
• If implemented after the offence it may bring about an alleviation of the main sanction and further exclusion of negative consequences (like the precautionary measures’ application).
